Terms and Conditions for Hatching Kit Rental

Please carefully read the following terms and conditions that govern the rental of equipment from Falls Farmhouse, LLC. By renting equipment from Falls Farmhouse, LLC, you agree to comply with these terms and conditions.

  1. Rental Agreement: The rental agreement begins when you receive the equipment and ends when the equipment is returned to us.
  2. Rental Period: The rental period starts on the date specified in the rental contract and ends on the date the equipment is returned.
  3. Rental Fees: Rental fees are calculated based on the rental period agreed upon. Additional charges may apply if the equipment is returned late or damaged.
  4. Security Deposit: A security deposit is required for renting equipment. This deposit will be refunded upon satisfactory return of the equipment. Equipment must be returned in the manor it was received.
  5. Order Cancellation: We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to, goods availability, errors in the description or prices for goods, errors in your order, we reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.
  6. Use of Equipment: The equipment must be used only for its intended purpose as specified by the manufacturer. Any misuse or unauthorized alteration of the equipment is strictly prohibited.
  7. Care of Equipment: You are responsible for maintaining the equipment in good condition during the rental period. Do not clean the equipment as water may damage the incubator. Falls Farmhouse, LLC will clean the equipment at the end of the rental period.
  8. Loss or Damage: You are liable for any loss, theft, or damage to the equipment during the rental period, including damage caused by misuse or negligence.
  9. Indemnification: You agree to indemnify and hold us harmless from any claims, liabilities, damages, or expenses arising from the rental or use of the equipment.
  10. Reservation and Cancellation: Reservations are subject to availability. Cancellations must be made within the specified timeframe to avoid fees. Please refer to your rental contract for details.
  11. Payment: Rental fees, security deposits, and any applicable charges must be paid in full prior to or upon the receipt of the equipment, unless otherwise agreed upon.
  12. Ownership: The equipment remains our property at all times. You have no ownership rights to the equipment, only the right to use it according to the terms of the rental agreement.
  13. Limitation of Liability: Notwithstanding any damages that You might incur, the entire liability of the Falls Farmhouse, LLC and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall the Falls Farmhouse, LLC or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Falls Farmhouse, LLC or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

  17. Jurisdiction: These terms and conditions are governed by the laws of the Commonwealth of Pennsylvania. Any disputes arising from the rental agreement shall be settled in the courts of the Commonwealth of Pennsylvania.
  18. Changes to Terms: We reserve the right to modify these terms and conditions at any time. Updated terms will be posted on our website or provided to you directly.
